CUE SHEET DETAILS for Productions using Kool Music tracks:

Licensee agrees to furnish Kool Music with a complete and accurate music cue sheet for any Project that is publicly broadcast or distributed theatrically within 30 days of such broadcast. Such cue sheets shall correctly identify the Copyright Owner, Publisher(s), Composer(s), Performance Rights Societes (for both Composers and Publishers), Song Title, Length of Use, Type of Production and where the production will be aired (Country and name of broadcaster). These terms apply to all music purchased or licensed from Kool Music.

This work is made and sold under license. By accepting this work, you agree to the following terms and conditions. Your use of this work is limited and restricted solely for the purpose of synchronizing recordings there from in timed relation with films, training or marketing presentations, radio and television presentations or commercials, and any other multimedia, audiovisual or computer generated displays, programs or presentations. Neither you nor anyone else may make any copies of any of the recordings on this work, except as may be designated to a single stand alone workstation for the purpose of specific audio and/or visual synchronization at your own facility. Transfer, copying or duplication of the work in whole or in part for any other purpose is expressly prohibited unless specifically authorized in writing by Kool Music. Transfer of one or more sounds to any format allowing network or remote access by two or more endusers requires a separate MultiUser License. This license does not include use in wireless products or cellular applications which require a separate license. Here are answers to some common questions about Production Music use and its associated rights:

What is "Copyright"?
It is the protection given by the governing body of each country to those who create intellectual property such as literary works, plays, songs, musical compositions, etc. "Copyright" itself includes three separate and distinct rights:
  • Synchronization: The right to synchronize music in timed relation with an audio/visual production.
  • Mechanical: The right to duplicate (make copies of) the music. ie: DVD's,  CD's, tapes etc.
  • Performance: The right to perform musical works in public through radio, television, theaters, concert halls, restaurants and bars, background music systems (banks, grocery stores, elevators), etc.
What is a synchronization license?
Also referred to as a "sync" license, it allows you to use a recording of a musical work to synchronize with your audio or audio-visual production. For example, as part of a film, video, television program, commercial (radio or TV), CD-ROM, DVD or web site. The music is synchronized, or recorded, in timed relation with the audio or visual images. All our music includes the "sync" rights for the above uses with no aditional fees.
What is a mechanical license?
A mechanical right, which is granted via a separate mechanical license, allows you to record and distribute (without visual images) a song on a CD or record for private use. You need a mechanical license to lawfully record and distribute DVD's, CD-ROM's, CD's, tapes or records. You must obtain such a license from either the copyright owner or its representative. Kool Music owns the Copyright to all our music.
Please explain the importance of performing rights.
Performing rights is the right to perform musical works in public through radio, television, theaters, concert halls, restaurants and bars, background music systems (banks, grocery stores, elevators), and so on. Radio and TV stations pay an annual fee to the performance rights societies (such as BMI, ASCAP & SOCAN) for the right to perform music over the air. From the data that these societies receive from stations (i.e. cue sheets), the relevant composers and publishers get their appropriate shares of performing fees (residuals) which is paid out from the pool of funds collected. The performing rights societies are part of an international network of affiliates which exchange cue sheets and program information and collect and distribute performing fees to composers and publishers around the world.
What is a Master Right?
It is the right to use a specific recording, or performance of a piece of music. Kool Music owns the Master Rights to all our music.
Why use Production Music? Can't I just use songs from a commercial CD or downloaded from the internet for my productions?
Many people believe that they can simply use a popular song in their production work. Since somebody owns the rights to that music, you would need permission from both the owner of the Copyright (usually the Publisher) and the owner of the Master Recording (usually the record company). These rights can sometimes be purchased, but can be extremely expensive. That's why using music from Kool Music makes so much sense! We own the rights to all our music, and the rights to use it in your productions are included in the very reasonable fees we charge.
What is a "Blanket License"?
A Blanket License gives the producer the right to use the music as much as he wants in as many productions as he wants on a lease basis for a specified term. All productions that are created while the lease is active can be used/broadcast in perpetuity.
What is a "Laserdrop License"?
A Laserdrop License makes music available to the producer on a "pay-per-use" basis, and he must pay a set fee each time he uses music provided by the company in a new production.
What is a "Buyout" License?
A Buyout License normally applies to CD's whereby the producer purchases the CD's of production music outright, and the purchase price includes the "sync rights" to unlimited use of the music in perpetuity. Click here for a list of our CD's that are available on a Buyout license.

In each of the above cases, the producer is still required to submit cue sheets and report usage to the appropriate performance rights society for all public performance of any production containing the music. This allows both the composer and the publisher to collect their share of performance royalties that come from societies such as BMI, ASCAP and SOCAN.
